Why is art the only human retrograde endeavour?

I think you have to separate "art" from "entertainment". Art needs no copyright, it is there to be enjoyed by all. Entertainment can be artfully done but rarely falls under the art category. Music is a lot closer than movies but once music is released it is for everyone.
